The regional centers serve as entry and exit points to the Divisions service system. They perform intake activities that help to determine if an individual is eligible for services. After a person is found eligible, the regional center, in partnership with the individual and family, works to identify needed services or supports. A comprehensive individualized plan (IP) is developed. In implementing the IPs, staff attempts to meet the needs of the person in the least restrictive setting through services and resources available through both public and private providers. Referrals to habilitation centers are made when it is determined these facilities are the most appropriate.
According to Revised Statutes of Missouri Law, all individuals admitted to the Marshall Habilitation Center shall have an appropriate and valid admission status. The law requires that the persons disability must have occurred before age 22 (during the developmental period) and that it is likely to continue indefinitely. In the state of Missouri, the age of majority is age 18. The following guidelines are used for legal status upon admission.
FINANCIAL
The Marshall Habilitation Center is certified as intermediate care facility/mental
retardation (ICF/MR) and participates in federally funded programs such as Title 19,
Medicaid and Medicare, as well as state financing. The cost of services is determined by a
Standard Means Test (SMT), a tool used to determine if the individual or family (in the
case of a minor child) is financially able to pay a portion of the costs. Charges are
determined using a table that evaluates family size, income, and the type of service.
However, many other resources, especially third party payments, must also be used to cover
costs.
DISCHARGE/PLACEMENT
An individual may be discharged from the Marshall Habilitation Center or may be
referred to a regional center for placement if it is determined in a comprehensive
evaluation or periodic review that the following criteria exist:
1) The individuals condition is not of such a nature that for the protection or adequate care of the individual or others that the individual needs department residential habilitation or other services;
2) The Marshall Habilitation Center does not offer a program which best meets the individuals needs; or
3) The Marshall Habilitation Center does not provide the least restrictive environment feasible. An individual may not be discharged without his consent, or consent of his parent if he is a minor, or guardian unless proceedings have been completed.
After the individuals discharge, the individual shall be referred to an appropriate regional center for assistance in obtaining any necessary services.
Parents of minors, guardians, or those who are voluntarily admitted by their signatures who express their desire to leave the Marshall Habilitation Center will be asked to sign a form requiring such a release. The superintendent will release the individual unless the physician assigned to them has indicated he feels that the individual may be dangerous to themselves or others. If he does, the superintendent has the right to detain the person up to ninety-six (96) hours, during which time a court hearing must be held to decide whether the person can be held.
